1. Acceptance of Terms

By accessing or using cloudnineau.com ("the Site") or placing an order, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Site.

2. Age Restriction

⚠️ You must be 18 years of age or older to use this site and purchase any products. By accessing the Site and confirming the age gate, you represent and warrant that you are at least 18 years old.

We reserve the right to cancel any order we suspect was placed by a person under the age of 18. Any person who misrepresents their age to purchase products accepts full legal responsibility for doing so.

3. Products and Descriptions

We make every effort to accurately describe our products including THC/CBD content, terpene profiles, weight, and effects. However:

  • Product descriptions are based on third-party lab results for that specific batch. Individual experience may vary.
  • Cannabis effects are subjective and depend on many factors including individual tolerance, consumption method, and dosage.
  • Product images are representative. Actual product appearance may vary slightly.
  • All weights are approximate and may vary within ±5%.
  • Stock availability is subject to change without notice.

4. Pricing and Payment

All prices are displayed in Australian Dollars (AUD) and include GST where applicable. We reserve the right to change prices at any time without notice.

We accept Bitcoin (BTC) and Ethereum (ETH) only. Cryptocurrency exchange rates displayed at checkout are indicative only. We accept payment within ±5% of the displayed rate to account for market fluctuation. Confirmed orders are binding once cryptocurrency payment is verified on-chain.

We do not accept credit cards, debit cards, bank transfers, PayPal, or any other payment method.

5. Orders and Fulfilment

An order is confirmed once your cryptocurrency payment is verified on-chain (minimum 1 confirmation). We will notify you by email once confirmed. We aim to dispatch all confirmed orders within 24 hours. Orders are shipped via Australia Post to the delivery address provided at checkout.

Incorrect address: You are responsible for providing an accurate delivery address. We are not responsible for orders lost due to an incorrect address provided by the customer. Reshipping in this circumstance will incur additional shipping charges.

6. Legal Compliance

Cannabis laws in Australia vary by state and territory. By placing an order, you represent that:

  • You have checked and comply with the cannabis laws applicable in your state or territory
  • Possession or use of cannabis in your jurisdiction is lawful for your circumstances
  • You accept full personal responsibility for compliance with applicable laws

Cloud Nine AU operates in good faith and complies with applicable regulations. We are not responsible for a customer's non-compliance with local laws.

To the maximum extent permitted by Australian law, Cloud Nine AU's total liability for any claim arising from use of the Site or purchase of products is limited to the total amount paid for the relevant order. We are not liable for indirect, consequential, incidental, or punitive damages.

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
